Terese Arenth is a partner with the firm and serves as Co-Chair of its Promotional Marketing and Advertising practice group.  Ms. Arenth concentrates her practice in promotional marketing, advertising and Internet/new media, as well as commercial and corporate litigation.  She also has significant involvement in the firm’s intellectual property and unfair competition practice area.

Ms. Arenth’s substantial experience in the firm’s regulatory, promotional marketing and advertising matters includes counseling clients in all aspects of direct marketing promotions, with an emphasis on promotions involving sweepstakes and contests, including drafting of rules for sweepstakes, contests and promotions, as well as sweepstakes registration, review of advertising promotions, and the negotiation and drafting of promotion-related agreements such as joint sponsor agreements, event sponsorship agreements, prize fulfillment agreements, vendor agreements, publicity releases and spokesperson agreements.  She also handles matters involving a variety of licensing, distribution and general corporate transactions, primarily in connection with the counseling, negotiation and drafting of licensing and distribution agreements, online privacy policies and website terms of use.  Ms. Arenth handles complex litigation in both State and Federal Courts, focusing on business disputes, equipment leasing, trademark, copyrights and unfair competition, as well as domain name dispute arbitrations.

Prior to joining the firm in 1996, Ms. Arenth began her career at the Manhattan law firm offices of Dow Lohnes & Albertson, a Washington DC-based firm, and Baer Marks & Upham LLP.

Ms. Arenth is admitted to practice in New York. She is also admitted to the U.S. Court of Appeals for the Second Circuit and the United States District Court for the Eastern and Southern Districts of New York.

Affiliations

Ms. Arenth is an active member of the Promotion Marketing Association and its Government and Legal Affairs Committee, as well as its NYC Chapter Committee.  She is also an active member of the Direct Marketing Association and the Direct Marketing Club of New York, in addition to the Intellectual Property Law Section of the American Bar Association where she currently serves as Chair of its Promotion & Marketing Law Committee and previously served two terms as its Vice-Chair.  Ms. Arenth has served as a speaker and author on various advertising, marketing and intellectual property law-related topics, including having served as a speaker and contributing author in connection with the Promotion Marketing Association’s Annual Law Conference and contributing to the ABA’s Annual Review of Intellectual Property Law Developments 2009.

Ms. Arenth is a member of the Equipment Leasing and Finance Association and is a contributing author to the ELFA’s online State Law Compendium. She serves as a member of the Nassau County Bar Association, participating in the Intellectual Property and Commercial Litigation Committees.  Ms. Arenth sits on the Advisory Board for Moms Who Kick Inc. and the Board of Directors for The Women’s Financial Group (TWFG), in addition to serving as Chair of TWFG’s membership committee,
